Apple has decided to backtrack on its decision to prohibit Epic Games from operating its own app store on iOS devices in Europe, marking a significant shift in the ongoing battle between the two tech giants.
Reversal Decision
The tech behemoth’s reversal came after facing pressure from European Union officials, who threatened to investigate the ban. Apple’s change of heart indicates a willingness to comply with regulatory scrutiny regarding its app store policies.
Epic Games’ Battle
Epic Games, renowned for its popular game Fortnite, has been engaged in a protracted struggle against Google and Apple over their control of in-app purchases within their ecosystems. This conflict escalated in 2020 when both Google and Apple removed Fortnite from their respective app stores due to Epic’s introduction of alternative in-game purchasing methods.
Fortnite’s Return
Following Apple’s decision to overturn the ban, Epic Games announced that Fortnite would once again be available on iOS devices. The company expressed satisfaction with the outcome, emphasizing the significance of swift regulatory action in enforcing the Digital Markets Act (DMA) to foster competition.
Digital Markets Act
The DMA, enacted into law in the European Union, aims to address the dominance of Big Tech firms and promote a more competitive digital marketplace. One key provision mandates app store developers to permit app downloads and purchases from third-party vendors, a measure designed to curtail the monopolistic control exerted by major platforms.
Apple’s Response
In response to the reinstatement of Epic Games’ app store account, Apple cited ongoing discussions with Epic Games and the latter’s agreement to adhere to new EU-centric policies. The move signifies Apple’s willingness to adapt its practices in alignment with evolving regulatory frameworks.
Legal Battles
Epic Games’ legal skirmish with Google culminated in a trial in November 2023, where a federal court jury ruled in favor of Epic, concluding that Google had maintained an unlawful monopoly through its Google Play store. Despite Google’s intent to appeal, Epic remains prepared to establish its own app store on Android should the verdict be upheld.
Although Epic faced a setback in a previous lawsuit against Apple in 2021, where the court largely sided with Apple, the ruling did compel Apple to permit apps to include links to alternative payment options, signaling a partial victory for Epic in its ongoing crusade for app store reform.
