Allegations of Retaliation Against Farmworker Over Wages

The US Department of Labor has taken legal action against Tennessee’s largest pork producer, Tosh Pork LLC, alleging retaliation against workers who inquired about their pay. The department filed a complaint and motion for a temporary restraining order against the company, citing violations of the Fair Labor Standards Act (FLSA).

Severed Pig’s Head Found

According to the Department of Labor, one Tosh Pork employee discovered a severed pig’s head at their workstation after discussing wages with management. The department did not identify the perpetrator of this disturbing act. Additionally, the employee allegedly faced threats of termination during the meeting with management.

Violations of Fair Labor Standards Act

The complaint filed by the DOL accuses Tosh Pork of violating sections of the FLSA, which protect workers’ rights to inquire about their wages without facing retaliation. Furthermore, the Act prohibits employers from discriminating against employees who have lodged complaints with the Wage and Hour Division.

Retaliation Against Another Worker

Another worker at the farm, responsible for caring for pigs, reportedly faced retaliation after questioning their pay. The DOL stated that this employee was assigned unrelated tasks, such as cleaning offices, bathrooms, and pig waste, in an apparent act of retaliation. Moreover, when Tosh Pork suspected the employee of filing a complaint, they allegedly attempted to coerce them into signing a document prohibiting discussions about pay with colleagues.

Response from Tosh Pork

In response to the allegations, Tosh Pork’s veterinarian, Seth Krantz, denied the accusations, asserting the company’s commitment to complying with the FLSA and treating employees respectfully. Krantz emphasized that Tosh Pork intends to contest the allegations in court.

DOL Findings

Additionally, the Department of Labor investigation revealed that Tosh Pork owed five workers a total of $39,375 in back wages, along with $36,731 in penalties. The department condemned the company’s actions, emphasizing its commitment to protecting workers’ rights and holding employers accountable for unlawful practices.
